Understanding Key Agreements
One of the key steps in this process is understanding the agreements we may use during our collaboration. Today, let’s break down the California REALTORS® Property Showing and Representation Agreement and compare it with the Buyer Representation and Broker Compensation Agreement.
Property Showing and Representation Agreement
This agreement is a vital tool that sets the stage for our working relationship. It outlines the terms under which I’ll represent you during your property search. This agreement covers up to three property showings and allows the agent to represent the buyer on transactions for any of the properties stated in the agreement. This is a non-exclusive agreement that can last up to 30 days. It’s a great way to meet an agent, giving both parties the opportunity to see if they want to work together.
Buyer Representation and Broker Compensation Agreement
On the other hand, the Buyer Representation and Broker Compensation Agreement is more comprehensive. This agreement formalizes my role as your agent throughout the entire home buying process. It includes:
- Non-Exclusive Representation: This agreement can also be non-exclusive, meaning you can have multiple non-exclusive agreements with different agents, but any agent that shows you a home either in person or virtually is entitled to the commission on that home. Should one agent show you a home and you decide to have another agent write the offer, you could be required to pay both agents’ commissions.
- Exclusive Representation: It ensures that I am your sole representative, dedicated to finding you the perfect home. This means you commit to working with me for a specified period, usually longer than the Property Showing Agreement (up to 90 days). The benefit of exclusive representation for the buyer is that the agent is also bound to you during the contract period and must work on your behalf.
- Broker Compensation: This section outlines how my broker Wealth Managers, Inc., and I will be compensated. It details the commission structure, which is often a percentage of the purchase price, but the specifics can vary.
